In Sistan and Baluchestan Province, laws governing polygamy are widely violated. Many subsequent marriages take place without the knowledge or authorization of the courts and, as a result, the principles set forth in the Family Protection Law are disregarded and justice among spouses is not upheld in practice. In numerous cases, the consent of the first wife is neither taken seriously nor considered at all.

Pursuant to Articles 14, 16, and 56 of the Family Protection Law, a man’s remarriage is permitted only if the following conditions are met:

  • Prior authorization is obtained from the court
  • The man’s financial capacity is verified
  • His ability to ensure justice among spouses is established
  • The official and documented consent of the first wife is secured, except in specific cases expressly defined by law
  • Marriage registrars are explicitly prohibited from registering any remarriage without a court ruling or authorization

These provisions were enacted to prevent coercion, abuse, and the violation of women’s rights. However, in Baluchestan, these laws are routinely circumvented:

  • Second and third marriages are conducted secretly and without recourse to the courts
  • Some marriage registrars, either deliberately or under social pressure, register marriages without the required legal documentation
  • The first wife is effectively kept uninformed, or her consent is disregarded
  • Baluch women face social stigma, economic pressure, and a lack of legal support when attempting to assert their rights

The consequences of this pattern are severe, including injustice within the family, psychological harm, economic insecurity for women and children, and the continued perpetuation of structural discrimination against Baluch women.

We, the signatories of this petition, call upon judicial and governmental authorities to:

  1. Strictly enforce Articles 14, 16, and 56 of the Family Protection Law in Sistan and Baluchestan Province
  2. Prevent the registration of any remarriage without a valid court order
  3. Investigate and address violations by marriage registrars who register polygamous marriages without legal authorization
  4. Ensure that the consent of the first wife is genuinely and formally obtained in all cases
  5. Establish accessible counseling and legal support centers for Baluch women
  6. Implement active monitoring and oversight in areas with a high prevalence of unlawful marriages

This petition does not conflict with religious principles. Rather, it calls for the enforcement of laws enacted within the Islamic Republic of Iran itself, laws intended to protect the family, ensure justice, and prevent harm. It should be noted that even these laws continue to operate primarily in favor of wealthy and financially secure men, and that in a just society where women and men enjoy equal rights, polygamy would have no place.

Under the current legal framework, polygamy without lawful authorization is both illegal and a source of injustice, undermining women’s dignity and destabilizing families, a problem that persists in Baluchestan on a widespread and deeply concerning scale.

We urge the authorities to act decisively.

Baluch women deserve justice, security, and full legal protection.
