We, the undersigned, strongly condemn the imprisonment of Fatemeh Atashi Khiyavi, a civic and political activist from Iran’s Azerbaijani Turk community, who is currently serving an unjust sentence in Tehran’s Evin Prison. We call for her immediate and unconditional release and the complete annulment of the verdict issued against her. Her case stands as a stark example of the violation of fair trial guarantees, fundamental human rights, and even the explicit provisions of Iran’s own Constitution.
Background and Legal Concerns
Ms. Atashi Khiyavi, 45, a resident of Tehran and a long-time advocate for Turkish cultural and linguistic rights, was arrested on February 23, 2025, after being summoned to the Evin Prosecutor’s Office, and transferred to Evin Prison to serve her sentence. She had previously been detained in February 2024 in Meshginshahr without a court order and held in Ward 209 of Evin Prison.
In the lower court, Branch 15 of the Tehran Revolutionary Court, presided over by Judge Abolqasem Salavati, sentenced her to five years in prison on the charge of “assembly and collusion against national security” and one year for “propaganda against the state.” On appeal, this was reduced to five years, of which three were suspended and two deemed enforceable. Under Article 134 of the Islamic Penal Code, the final sentence should have been one year of imprisonment; however, she has recently been informed that two years will be enforced, and that she is excluded from the recent general amnesty decree.
All of Ms. Atashi Khiyavi’s activities have been peaceful, civic, and fully within the bounds of cultural and social advocacy. There is no evidence whatsoever of violence or threat to national security. Her prosecution and imprisonment blatantly violate Articles 23, 27, 37, and 38 of the Constitution, which safeguard freedom of belief, peaceful assembly, the presumption of innocence, and the prohibition of torture. They also contravene Iran’s obligations under the International Covenant on Civil and Political Rights, including the right to a fair trial (Article 14), freedom of expression (Article 19), and freedom of assembly and association (Articles 21 and 22).
Our Demands
We therefore call upon the authorities of the Islamic Republic of Iran to:

Immediately quash the prison sentence of Fatemeh Atashi Khiyavi and release her without conditions;

Apply the general amnesty decree to her case without discrimination;

Conduct a transparent investigation into her arrest, detention conditions, and the denial of her legal rights;

Provide full redress and compensation for the harm she has suffered as a result of unlawful imprisonment;

End the criminalization of peaceful civic and cultural activities;
-
Ensure the safety and freedom of all civil, political, and cultural activists in accordance with Iran’s Constitution and its international human rights obligations;
-
Uphold justice, human dignity, and constitutional principles in all judicial and governmental conduct.
Fatemeh Atashi Khiyavi is not a criminal, nor is she a threat to national security. She is a civil activist and a woman of conscience, punished solely for defending the cultural and human rights of her community. Her continued imprisonment constitutes a gross miscarriage of justice and reflects ongoing discrimination against Turkish and other minority activists in Iran.
We urge the Iranian authorities to act in accordance with justice, humanity, and their own constitutional duties by immediately releasing Fatemeh Atashi Khiyavi and ending the persecution of peaceful activism.
